I. Acceptance of These Terms of Service
1. BY DOWNLOADING, INSTALLING, OR USING Flashlight X - Brightest LED Light (“SERVICE” , “Flashlight X - Brightest LED Light”, “we”, “us”, “our”), YOU AGREE TO BE BOUND BY BOTH THESE TERMS OF SERVICE（“TOS”） AND THE PRIVACY POLICY. YOU CAN CHECK THE MODIFIED VERSION FROM THE SOFTWARE OR THE OFFICIAL WEBSITE. YOU UNDERSTAND AND AGREE THAT IF YOU CONTINUOUSLY USE Flashlight X - Brightest LED Light AFTER THE DATE ON WHICH the TOS HAVE CHANGED, Flashlight X - Brightest LED Light WILL TREAT YOUR USE AS ACCEPTANCE AND COMPLIANCE WITH THE UPDATED TERMS.
2. Flashlight X - Brightest LED Light may also offer other services that are governed by different TOS. In such cases the other TOS will be posted on the relevant service to which they apply.
3. If you do not agree with the TOS, please do not use or access Flashlight X - Brightest LED Light.

II. Privacy Policy
Flashlight X - Brightest LED Light collects information from you in order to provide better service and user experience to you. Your privacy is important to us and always has been, and this Privacy Policy explains how we collect, use, and protect the information.
What Information we collect and how we use your information
We collect various types of information in connection with the Service, including:
1. Camera
Take pictures and videos
The only purpose using this permission is to use camera LED as flashlight. We won’t use camera to take picture or video.
2. Photos⁄Media⁄Files
Modify or delete the contents of your USB storage
Test access to protected storage
When user recommends friends to download Flashlight X - Brightest LED Light by sharing to social network, we need to save an introduction picture to be shared on SD card. We won’t access other file on SD card.
3. Network connection
View network connections
Full network connections
We use these permissions to determine network status, and collect basic anonymous Flashlight X - Brightest LED Light usage data.
4. Other
Run at startup
Draw over other apps
Control vibration
We use these permissions to provide many useful features, like vibrating when user turns on/off flashlight, displaying operation instruction on other apps, preparing flashlight for use when android reboot.
How we protect your information
We have implemented commercially reasonable technical and organizational measures to protect your personal information from accidental loss and from loss, misuse and unauthorized access, disclosure, alteration and destruction. However, please note that although we take reasonable measures to protect your information, no app, website, Internet transmission, computer system or wireless connection is completely secure.
How we share your information
We may retain third parties to perform services on our behalf and we may collaborate with third parties with respect to particular products or services, these third parties may be provided with access to the information needed to perform their functions, as long as they agree to keep the information confidential. And We reserve the right to disclose your information as required by law, when we believe disclosure is necessary to comply with a regulatory requirement, judicial proceeding, court order, or legal process served on us, or to protect the safety, rights, or property of our users, the public or Flashlight X - Brightest LED Light.

We are committed to protecting the privacy of children. We do not knowingly collect personal information from children under the age of 13.

III. Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK AND THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. UNLESS EXPRESSLY SET FORTH HEREIN, Flashlight X - Brightest LED Light MAKES NO WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO ANY MATTER, INCLUDING WITHOUT LIMITATION ADVERTISING AND OTHER SERVICES, AND EXPRESSLY DISCLAIMS THE IMPLIED WARRANTIES OR CONDITIONS OF NONINFRINGEMENT, MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE. Flashlight X - Brightest LED Light DOES NOT WARRANT THE RESULTS OF USE OF THE SERVICE, AND YOU ASSUME ALL RISK AND RESPONSIBILITY WITH RESPECT THERETO.

IV. Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT Flashlight X - Brightest LED Light AND ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO THE BREACH OF THE TOS OR THE USING OF SERVICE, EVEN IF Flashlight X - Brightest LED Light HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

V. Indemnification
You agree to indemnify and hold Flashlight X - Brightest LED Light and its affiliates, subsidiaries, employees and agents harmless from and against any third-party claim and any related losses, costs, liabilities and expenses, including reasonable attorneys’ fees, arising out of the breach of any representations, warranties or covenants made by you.

VI. Governing Law and Disputes Resolution
Except to the extent that: (i) any applicable additional terms incorporated into these Terms provide differently, or (ii) the applicable laws and regulations of your jurisdiction mandate otherwise, the TOS and any dispute or claim arising out of or in connection with the TOS will be governed by the laws of the People’s Republic of China.
Any dispute, controversy or claim (whether in contract, tort or otherwise) arising out of, relating to, or in connection with the TOS, including their existence, validity, interpretation, performance, breach or termination, will be referred to and finally resolved by arbitration administered by the China International Economic and Trade Arbitration Commission (CIETAC), and the place of arbitration shall be in Beijing. Within the valid period for the arbitration, such arbitration tribunal shall subject to the arbitration rules of the CIETAC in effect at the time of the arbitration. The award of the arbitration tribunal shall be final and binding upon the two parties.
